General Terms and Conditions of Sale
Article 1 – Definitions
These General Terms and Conditions of Sale (hereinafter the “GTCS”) are offered by 9165-6967 Qc Inc., registered under number 1163510895, with its registered office at 121, rue d'Évain, Rouyn-Noranda, Quebec, Canada, J0Z 1Y0 (hereinafter “Skylee”).
The following terms are defined as follows:

“Site”: the website “https://www.skylee.com” and all its pages, exclusively owned by the Company.

“Products” or “Services”: all products (physical goods) and services (services) available for purchase or subscription on the Site.

“Seller”: Skylee, whether a legal or natural person, offering its Products or Services on the Site.

“Customer”: any internet user, whether an individual or a professional, purchasing Products or Services on the Site.

“Consumer”: as defined in the preliminary article of the French Consumer Code: any natural person acting for purposes outside their commercial, industrial, craft, or professional activity.
Users visiting the Site and interested in the Products and Services offered by the Seller are invited to read these GTCS carefully, print them, and/or save them on a durable medium before placing an order on the Site.
The Customer acknowledges having read the GTCS and accepts them in full.
Article 2 – Scope and Purpose of the Site
The Seller reserves the right to modify the GTCS at any time by publishing a new version on the Site.
The GTCS applicable to the Customer are those in effect on the day of the order.
Legal information regarding the website host and publisher, data collection and processing, and website terms of use are provided in the Terms of Use, Legal Notices, and Data Charter of the Site.
This Site offers online sales of DIY tools. Access to the Site is free for all Customers. Ordering a Product or Service constitutes acceptance of the GTCS, which takes precedence over any other documents (catalogs, advertisements, notices), except for any prior and express derogatory agreement with the Company.
Acceptance of these GTCS assumes that Customers have the legal capacity to do so. If the Customer is a minor or lacks legal capacity, they declare having obtained authorization from a guardian, curator, or legal representative.
The Customer acknowledges the evidentiary value of the Seller’s automated recording systems and, unless proven otherwise, waives the right to contest them in case of dispute.
Article 3 – Customer Service
Customer service can be contacted via email at contact@skylee.com, via the website form, or by postal mail as indicated in the legal notices.
Professional inquiries (partnerships, media, contract proposals) must be addressed by email only to contact@skylee.com.
Article 4 – Ordering Process
Products and Services offered are listed in the catalog on the Site. Each product includes a description provided by the Seller based on supplier information.
Photos on the Site are non-contractual and may differ from the actual product due to screen settings, lighting, angle, etc.
The “Cart” is defined as the virtual container grouping all Products or Services selected by the Customer for purchase. Customers select products by adding them to their Cart, which can be modified at any time.
To place an order, the Customer:

Adds products to the Cart.

Reviews and corrects the order on the Cart page.

Provides contact information and optionally subscribes to order tracking.

Chooses a shipping method.

Enters payment details and billing address.

Applies any promotional codes.

Confirms the order by clicking “Finalize my order”, accepting the GTCS, and paying for the order.
The order date corresponds to the date of receipt of full payment.
Article 5 – Prices and Payment
Prices listed in the catalog are in Euros, inclusive of all taxes (VAT at the rate in effect on the day of order), excluding possible shipping or processing fees.
The Seller reserves the right to adjust prices in case of changes in VAT rates. Prices in effect on the order date are binding.
Payment methods include Credit Card, Bancontact, Apple Pay, PayPal, and online banking transfers. Payments are processed securely via third-party providers.
The Site does not have access to payment data. Payment is made directly to the bank or payment provider.
Article 6 – Delivery
Shipping fees are indicated before payment. Delivery is possible worldwide. Delivery times are indicative and may be affected by postal delays or unforeseen circumstances.
For deliveries outside the EU or in overseas territories, the Customer is the importer and accepts that the Seller may not provide exact customs duties or import taxes.
Delivery to the Consumer is guaranteed within 30 days unless otherwise stated.

For in-person delivery, the Customer may refuse a damaged or incomplete package, noting any anomalies on the delivery receipt.

For mailbox delivery, the Customer must check immediately and notify support of anomalies.
If a package is returned, the Seller will contact the Customer. Costs for re-shipment are the responsibility of the Customer if the refusal was incorrect.
Delays beyond 30 days allow the Consumer to cancel the order with written notification. Refunds will be issued within 14 days.
Article 7 – Right of Withdrawal
Consumers have 14 calendar days from receipt to return a product for exchange or refund, excluding return shipping costs.
Products must be unused, in original packaging. Refunds will be processed using the original payment method unless otherwise agreed.
Damage from misuse outside inspection of product nature or functionality may reduce refund eligibility.
Article 8 – Product Warranty

Legal conformity warranty: The Seller must deliver products conforming to the contract and respond to defects present at delivery.

Hidden defects warranty: Consumers can claim remedies under Articles 1641–1644 of the French Civil Code within 2 years of defect discovery.
Article 9 – Liability
The Seller is not liable for contract non-performance due to force majeure, indirect damages, or loss of profit.
Product choice and use are the Customer’s responsibility.
Article 10 – Force Majeure
Events beyond reasonable control that prevent contract performance constitute force majeure. Execution is suspended.
If the situation persists beyond 90 days, either party may terminate the contract via registered letter.
Article 11 – Intellectual Property
All content on the Site is the Seller’s property or used with permission. Reproduction or use without authorization is prohibited.
Trademarks and logos may be registered. Unauthorized use may lead to account termination and legal action.
Article 12 – Personal Data Processing
Customer data is collected for order processing, customer communication, and website improvement.
Data is stored securely and retained for no more than five (5) years.
Customers have the right to access, correct, delete, or object to their data via contact@skylee.com.
Article 13 – User Comments
Customers grant the Seller the right to use any submitted ideas or comments.
Comments must not violate third-party rights or contain illegal content.
Article 14 – Severability
If any provision is invalid, it does not affect the validity of other provisions.
Article 15 – Governing Law and Mediation
GTCS are governed by French law.
Disputes may be submitted to mediation or the competent Estonian courts.
Article 16 – SMS Marketing Policy
By consenting, Customers agree to receive transactional and promotional SMS. Messages can be unsubscribed via STOP. No purchase is conditional on consent.
Warranty on Parts: Limited to 30 days after purchase.
